Here’s a question we encounter: "Can I get in trouble for participating in a class action settlement?"

Unlike participating directly in the lawsuit, if you’re looking to get in at the end of the line (i.e., at the settlement), all of this work has been done on YOUR behalf and all the others affected. The real question is, “what are you waiting for?”

Still worried? Don’t be. Individuals and businesses joining a class action settlement for which they qualify aren’t heading for trouble! We’ll cover participating in a lawsuit in a later newsletter… but for now, let’s address some settlement-related questions:

Can I get in trouble with the Defendant involved?
Nope! Defendants aren't privy to the list of claim filers, as the courts and judges ensure there's no room for retaliatory antics. The courts overseeing the case will appoint a claims administrator – a neutral third party – that’s responsible for member identification and funds distribution.

What if that Defendant is my employer?
No again. The same rules apply – defendants, even if they're your employer, can't peek at the list of claimants. Courts and judges won't stand for any funny business – plus, federal law protects you against retaliation from your employer if you participate in the lawsuit (not just settlement).

Is there a way I could get in trouble?
Here’s one: submitting a claim in a case you DON’T qualify for. Remember, this is the legal system we’re dealing with and perjury exists… be smart and file for settlements that apply to you. Plus, don’t ruin it for the rest of us.

⏱️ TL;DR: Here’s the Scoop
It's actually in the Defendant's best interest for you (and MANY others) to qualify for the settlement. Why?

🍯 Settlement Fund: That money is earmarked for payment, and unless their legal team pulled off some magic and negotiated unclaimed funds returned to the company, that money is as good as gone.

🧑‍🤝‍🧑 Claimants: The more that qualify for the settlement, the more that are no longer eligible to sue down the road for the same issue. In many cases, Defendants will provide records of those potentially affected to make the list as far-reaching as possible AND THUS reduce the chance of further litigation.

💲Get Paid: Guess what? You could qualify for a settlement whether you file a claim or not. So why not file your claim and make sure you get paid (only IF you qualify!)?
