Let’s Break Down How Funds Are Usually Split

How settlement funds are paid out depends on the agreement reached between class counsel attorneys and the defendants. Here are a few examples of how funds are usually split up:

Pro Rata (Proportional) Distribution
In some cases, funds are split proportionally among those affected:

  • 💳️ Visa Mastercard Settlement (open): Merchants can receive a payment based on their share of the total alleged overcharged interchange fees – that’s $5.5 Billion on the line…

  • 🚚 Hino Motors Emissions Settlement (closed): Truck drivers were expected to receive $1,500 to $15,000 per claim, depending on how many truck owners filed.

In pro rata settlements, the payout can be larger OR smaller than expected depending on the number of claims submitted.

🔝 Set or Capped Amount Per Claimant
Some settlements have a fixed or capped amount for each claimant:

  • 🍊 Walmart Weighted Groceries Settlement (closed): shoppers were eligible for $10-25 back based on items purchased (without receipts) or up to 2% of all purchases, capped at $500.  

  • 📵 Verizon Admin Fee Settlement (closed): Claims started at $15 and added $1 every month they had a postpaid plan, capped at $100.

  • 💄 GrandeLash-MD Settlement (closed): Shoppers were eligible for up to $150, with an additional $150 if they had proof of two or more purchases.

🎟️ Coupons or Vouchers
Some class action settlements may offer a coupon or voucher instead of cash. However, these types of settlements are becoming less common since the passage of the Class Action Fairness Act in 2005.

What to Keep in Mind
Understanding how a settlement is split can help you gauge your potential payout. Depending on the method, some funds may go unclaimed if people don’t file…
