š§ Why Haven't I Heard About Class Actions Before?
Iām gonna make the bold statement and say, that if youāre an everyday American, buying everyday productsā¦ chances are that you have been affected by AT LEAST one class action settlement.
āOK wise guy, then why havenāt I heard of all these cases?ā
In reality, they probably tried. Whether it was sad post card in the mail, a website ad banner, an email that either gets delivered straight to your spam folder, OR you move it there after thinking, āthereās no way this is legitā, they havenāt been grabbing your attention. Donāt worry, you're in good company.
Many Americans are unaware of class action lawsuits and settlements that may have been affected by. Letās dig into a number of reasons why this news may not be reaching āem:
1) Notification requirements
Oftentimes the courts and administrators rely on less-than-effective methods: sad postcards in the mail, emails that look like spam (or end up in your spam folder), newspaper ads, or even billboards that probably donāt reach all those affected.
2) The law doesnāt read quite like Shakespeare
Weād bet not many of you want to read through the long, complex class action lawsuit documents, sifting through brain numbing legal jargon to recover $20ā¦š« (donāt worry, weāre here to take care of that for you)
3) Disproportionate media coverage
You know how in the news youāll see the same story every hour on the hour for a week but then something that happened close to you just scrolls across the bottom. Well, this same concept applies to class actions. While some high-profile cases garner significant media attention, many others may not receive the same level of (or any) publicity. Whatās the problem? Well this contributes to the overall obscurity surrounding class actions for a substantial portion of the populationā¦ and thus people donāt know to file to get whatās owed to them.
4) Email turnover is surprisingly high..?
Itās a staggering fact but it's been found that over one in three people change their email address every year for various reasons, making it difficult for class administrators to reach potential class members. Pair that with ever growing spam folders, and thatās no surprise the news isnāt getting through.
Great, so all hope is lost.
Quite the opposite! Weāre on a mission to bridge the gap between these settlement cases and you, helping inform and educate as many people as possible so they can reclaim whatās theirs.
Can it really be that bad? Keep reading!
NUMBER CRUNCHERS
š¢ Are you underestimating the impact class actions can have on your wallet?
Like when someone creates a posts and nobody likes it ā thatās how class action settlements must feel.
Donāt take our word for it, the Federal Trade commission (āFTCā) spent a lot of hours analyzing what worked (and what didnāt), producing some of the saddest filing rates weāve ever seen. Letās peek at whoās (not) filing and some more hopeful rates for those out there still on the fence:
Of 150 class action settlements surveyed, the FTC found the median claim rate to be ~9% (< 1 in 10). More baseball fans are likely to root for the NY Yankees (1 in 9.77)ā¦
The report shows that 12-15% were undelivered and 15% that were delivered, remained unopenedā¦ HOWEVER, of the claims filed, 86% were approved.
Settlements get a bad rap of paying you $7.37, and while those to occur, the FTC found that consumer settlementās median compensation payouts are MUCH better - check them out:
1) 50% of claims are $69+
2) 42% of claims are $100+
3) 25% of claims are $200+

DID YOU KNOW? ļ»æFun Fact: Environmental class actions have played a role in holding companies accountable for pollution and hazardous waste disposal. Example: in 2018, a California resident brought a class action suit against Keurig, a maker of plastic coffee pods because the company claimed its pods are recyclable, though in many places they are not, which ended up settling for $10 million. |
