If you were with us two weeks ago, you saw that you may have been overcharged for raw chicken - well, theyāve come for your pork chops and bacon too. First they came after chicken, and now theyāve come for pork? Yes to both. 'Big Pork' is paying back $75 million to customers who purchased fresh or frozen raw pork products. In case you missed it, check out our chicken settlement newsletter. Now back to pork:
Whoās in the 'Big Pork' lineup? Clemens Foods (Food Group, Family Corporation, Hatfield Quality Meats); Hormel Foods Corporation; JBS Foods; Seaboard Foods; Smithfield Foods; Triumph Foods; Tyson (Foods, Prepared Foods and Fresh Meats Inc.); and Agri Stats, Inc.
What Happened?
The plaintiffs allege that Defendants and their co-conspirators conspired and combined to fix, raise, maintain, and stabilize the price of Pork products with the intent and expected result of increasing prices of Pork products in the US, violating federal and state consumer and antitrust laws.
What does that meanā¦in English, please?
It means that these big pork producers 'allegedly' attempted to charge you more by working together (i.e., against capitalismā¦) but got caught messaging each other what they all should chargeā¦ yikes. So if you qualify, you could be eligible for your share of the $75 million settlement! Check out the criteria below to see if you fit the bill.
Class Member Criteria
š You bought fresh or frozen raw pork for personal consumption.
š You purchased in the select locations listed below.
šļø Those purchases were between Jun 28, 2014 to June 30, 2018.
š§¾ No proof of purchase is necessary but the administrator may ask for additional information or documentation later.
āš FINE PRINT šā
Includes the following types of raw pork, whether fresh or frozen: raw pork bacon, bellies, loins, shoulder, ribs, or pork chops.
Excludes any product marketed as organic, no-antibiotics ever (NAE), and any product other than bacon that is marinated, seasoned, flavored, or breaded.
Locations: Arizona, California, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Rhode Island, South Carolina, Tennessee, Utah, and West Virginia.
PLEASE NOTE: Purchasers in Kansas, Tennessee or South Carolina, the class period is starts June 28, 2015 (NOT June 28, 2014).
Did I have to buy from ONLY the named companies?
Short answer: No. Long answer: The court has approved settlements between the plaintiffs and certain defendants (JBS and Smithfield), but the case continues against those who haven't settled (referred to as "Non-Settling Defendants"). If you're part of the Certified Class, you may receive further updates on the litigation's progress and any outcomes involving the Non-Settling Defendants.

Just like in the chicken case, if you donāt qualify (like the only pork chop in your house is a 5-year-old french bulldogā¦), DONāT submit a claim.
